SUPPORTERS of Terri’s cause are IGNORING the absolute legal protection provided by Florida and Federal law concerning witholding water and food from the disabled:

Why in God’s Holy Name are you not invoking this?

Michael can ONLY remove the feeding tube if that act does not interfere with providing Terri water and food. What he did last time, withholding water and food, was absolutely illegal!!!!

The Americans with Disabilities Act (ADA), 42 U.S.C. Sections 12101 provides that necessary and appropriate rehabilitation services and physical motor skill therapy may not be denied a substantially disabled patient in the United States of America.

Cf 28 CFR, Ch 1, Subpart B, Sect 35.130 States

“Nothing in the Act or this part authorizes the representative or guardian of an individual with a disability to decline FOOD, WATER, medical treatment, or medical services for that individual.”

WAKE UP, PEOPLE!!!!

    They wouldn’t execute a prisoner by starvation…it’s cruel and unusual. But they won’t use lethal injection to kill Terri because it would be a more active role in her dying. They wouldn’t be able to say that they “let her die.” They’d have to come out and say they put her to death. So I don’t see what the difference is. Where are those who protest in defense of killers and rapists? Shouldn’t they be defending her as well?

    “Necessary and appropriate” isn’t exactly a definitive category, and to “not authorize” is not the same as to prohibit.

    It does not give the guardian permission or the right or the authorization to deny the ward sustenance (food and water), the language is plain. Euthanasia is illegal. I think some people are trying to fool us to believe that it is, but it isn’t.

    “Necessary and appropriate” would mean, for example, giving someone a dental exam like a regular person, rather than stop giving her dental care, requiring that eventually 5 teeth have been removed from Terri’s mouth. She has not had a dental exam since 1995. That is not conducting “necessary and appropriate” dental care, I think anyone can see that when her teeth are starting to rot in her mouth. “Necessary and appropriate” would mean keeping the room at a reasonable temperature-not turning the room temperature down to a little over 60 degrees in the hopes that she would catch pneumonia. “Necessary and appropriate” means–turning the patient so she doesn’t get bedsores, giving her antibiotics when she has an infection, all of which he tried to stop. And so on.

    She has received absolutely no rehab AT ALL, no swallow test, although she can swallow, no vision test, no NOTHING. Not even trips outside for fresh air.
