Miers Withdraws Her Name from Supreme Court Nomination
Miers Withdraws Supreme Court Nomination-from Chicago Tribune:
WASHINGTON — Harriet Miers withdrew her nomination to be a Supreme Court justice Thursday in the face of stiff opposition and mounting criticism about her qualifications.
President Bush said he reluctantly accepted her decision to withdraw, after weeks of insisting that he did not want her to step down. He blamed her withdrawal on calls in the Senate for the release of internal White House documents that the administration has insisted were protected by executive privilege.
“It is clear that senators would not be satisfied until they gained access to internal documents concerning advice provided during her tenure at the White House — disclosures that would undermine a president’s ability to receive candid counsel,” Bush said. “Harriet Miers’ decision demonstrates her deep respect for this essential aspect of the constitutional separation of powers — and confirms my deep respect and admiration for her.”
Miers’ surprise withdrawal stunned Washington on a day when the capital was awaiting news on another front — the possible indictment of senior White House aides in the CIA leak case.
Miers told the president she was withdrawing at 8:30 p.m. Wednesday. In her letter dated Thursday, Miers said she was concerned that the confirmation process “would create a burden for the White House and our staff that is not in the best interest of the country.”
She noted that members of the Senate had indicated their intention to seek documents about her service in the White House in order to judge whether to support her nomination to the Supreme Court. “I have been informed repeatedly that in lieu of records, I would be expected to testify about my service in the White House to demonstrate my experience and judicial philosophy,” she wrote.
“While I believe that my lengthy career provides sufficient evidence for consideration of my nomination, I am convinced the efforts to obtain Executive Branch materials and information will continue.”
Interesting development.
Michelle Malkin has a great roundup.

As predicted Harriet Miers withdrew her nomination this morning. Her nomination was going no where and she was hurting President Bush. For the good of the President, herself and the country she graciously withdrew her name as a Supreme Court Justice. I…

I’m surprised she had the temerity to back down. It’s probably the best possible development in this particular fiasco.
Let’s hope that a more qualified, less controversial candidate is floated up pretty quickly…

Personally, I’m ashamed it came to this. For the first moment in my life I feel many of my fellow Conservatives are no better than the Libs. Do they feel proud now? On the other hand, I really do believe the president overestimated the unquestioning support he would receive on this issue. What a mess.

If nothing else, the outpouring of outrage with the president’s choice from conservatives just proved that the President’s support is waivering.
He probably should have made a stronger choice from the outset. I think many people feel betrayed by his apparent compromise on so many issues when the Republican Platform was clear.
This is a deep concern to me while I’m trying so desperately to counter the anti-war radicals on my home turf, and how important it is to fight the war on terror.
We can’t let the liberals take control; it will surely mean the end of us. I can see many battles ahead, like the borders issue and so many other things–and we have gravitated so far away from what the founders had in mind when they wrote the founding documents…not the least of which is the “new” theory that the constitution is a “living” document.
We need a strong constitutional constructionist in this position who understands the spirit of the founding documents and will interpret existing laws and not legislate from the bench.

I’m ashamed that the President tried to pass her off as someone qualified. I’m ashamed that other Republicans were ready to get in lock-step with him and support her. I am ashamed that Republicans were mad at Republicans when they were intellectually honest and said she wasnt the woman for the job….
but, tomarow is a new day.
