The right to die movement: using Terri Schiavo

A few blogs in the blogosphere are linking to me claiming that I’ve made Terri Schiavo a “political football”. You’ll excuse me if I don’t link back to these idiots–all I can think of is they’re starving for hits. Running away to a corner and complaining about what I’m saying is either a pathetic attempt for attention from the 2 readers they have or…just an act of simple cowardice. To imagine that I am capable of creating a “political football” out of this is by itself an extraordinary example of stupidity. A strange backhanded compliment, of sorts, to imagine that little lonely me all by myself could single-handedly start a firestorm of controversy is also somewhat ridiculous. But of one thing I’m certain: They are coming here and reading. They’re not commenting, but they are reading.

It is interesting, at any rate, that these people are 1) not courageous enough to face me and 2) not intelligent enough to realize this is a national debate.

You mean euthanasia isn’t a concern to anyone and everyone who has loved ones? Has it occurred to anyone that you yourself might get sick at some point and need some TLC? Who knows what could happen to you at some point in your life? My Uncle, who is a minister, says–true love is when you carry your loved one to the bathroom when they’re sick and care for them. At least that’s the concept I’m familiar with. Life isn’t always a bed of roses, it’s “for better or worse”. You don’t just toss someone’s life away as though it has no meaning. Whatever happened to the idea of sanctity of life? If someone’s going to leave you, you should get on with your life, not try to strangle them to death.

In nazi Germany, the Third Reich practiced euthanasia on mental patients. By the end of 1939, four men, in the presence of a group of physicians and a chemist, were deliberately killed with carbon monoxide. They were not even criminals or troublemakers. They were cooperative and confident. They were ordinary patients in a Public psychiatric hospital, responsible for their welfare. This “successful” experience led to the installation of gas chambers in many psychiatric hospitals (Grafeneck, Brandenburg, Hartheim, Sonnenstein, Hadamar, Bernburg). An important number of hospitals and psychiatric institutions, professors of psychiatry, hospitals’ directors and staff were involved in this. Mass elimination became a routine job. They created a specialized transport agency, built ovens in psychiatric hospitals, etc. Those psychiatrists followed on a voluntary basis, the same principle as the one of the famous concentration camp commander Koch: “In my camp there are no ill people. There are the healthy ones and the dead”. However, this operation was hidden under different names : “help to dying patients”, “liberation through death”, “destruction of worthless lives”, “euthanasia”, “charitable action”.

Do those words sound familiar to you? They should. They’re the exact words they’re using in the case of Terri Schiavo.

We have evolved into a disgusting narcissistic society and people are selfish enough not to want to be inconvenienced by a sick loved one. We are already shipping off our elderly into nursing homes rather than keeping them with our families, how much of this is absolutely necessary? There comes a time when you just can’t handle the care of an elderly relative anymore…I’ve known alzheimers cases where the alzheimer’s patient kept slipping outside. A few have been hit by cars. A recent story had one freeze to death in the cold.

If you recall the case of Karen Ann Quinlan in the ’70’s, she was in a coma. She was curled into the fetal position and was on life support. Her parents were drained from the experience and went to court to take her off of life support. She lived 10 more years after that, she was breathing on her own.

But such is not the case with Terri Schiavo. Terri managed to survive her husband’s deadly assault and has a family who still loves her. Even though her husband has now taken his crusade to extinguish her life to the courts. I can’t believe it has gone this far! But then…I don’t know how many cases there are where this has been done before. Raven tells me this goes on a lot.

That is the most supreme idiocy. Activist judges create their own problems, as is the case with Judge Greer. Judge Greer could have chosen to follow the law in this instance, the fact that he choses not to has created a blogalanche of interest from coast to coast.

Liberals wishful thinking

Rice boldly eschewed the typical fare chosen by powerful American women on the world stage. She was not wearing a bland suit with a loose-fitting skirt and short boxy jacket with a pair of sensible pumps. She did not cloak her power in photogenic hues, a feminine brooch and a non-threatening aesthetic. Rice looked as though she was prepared to talk tough, knock heads and do a freeze-frame “Matrix” jump kick if necessary. Who wouldn’t give her ensemble a double take — all the while hoping not to rub her the wrong way?

Rice’s coat and boots speak of sex and power — such a volatile combination, and one that in political circles rarely leads to anything but scandal. When looking at the image of Rice in Wiesbaden, the mind searches for ways to put it all into context. It turns to fiction, to caricature. To shadowy daydreams. Dominatrix! It is as though sex and power can only co-exist in a fantasy. When a woman combines them in the real world, stubborn stereotypes have her power devolving into a form that is purely sexual.

sheesh. Just because Dr. Rice is a smart, fashionable girl, this has become all about sex instead of the job she’s doing? It’s almost as bad as this. Funny how the “liberals” are revealing themselves to be anything but “free from bigotry” and “tolerant of the ideas and behavior of others”. Leave it to a liberal to turn an article about Condi into a heavy breathing session. Hell, I thought they were the ones who thought Condi always looks “mean”.

What is it about SC&A that I understand so completely?

What it is about SC&A? Take a look at this post: Terry Schiavo, Who Cares? You ready?

No one likes having to deal with the chronically ill. They can be very, shall we say, messy. The impaired require round the clock care, medical attention, drugs and constant supervision. Having to care for an impaired person around impacts a lot of people. Social lives are curtailed, vacations become harder to come by and the constant focus on the sick person gets old, fast. Friends don’t want to hear or even care about your sick relatives. If you persist with the care giving, well, you just aren’t fun anymore. People you know would much rather talk about their jobs, cars, investments, politics, self esteem, sex, music, home decorating, clothes, fine dining, mortgages and of course Desperate Housewives and Sex in the City reruns- you know, the important things in life.

So here’s the bottom line.

We need to support a logical and compassionate Eugenics program. That’s right- only those that are worthy, as decided by the courts and a few doctors, shall be allowed to live.

Pretty powerful stuff, heh?

We had a discussion over email the other day - about 8 of us–about SC&A. Some people just don’t “get” his blog, or his statements. Somehow, I totally understand the dry humor, the sarcasm, the witicism that he demonstrates in such a brilliant but restrained monty python fashion.

is the explanation of what this blog is about, since so many of the new readers coming there are looking around thinking, WTF?

It has been brought to our attention that some of our readers don’t quite ‘get’ SC&A.

With that in mind, we wish to explain the SC&A blog, and by extension, the author.

The SC&A blog voice is a parody and an exaggeration of the personas of Sigmund Freud, Carl Jung and Alfred Adler. Anyone with even a cursory knowledge of those individuals and their schools of thought, should be able to see and understand those voices. It is also true that having an undergraduate degree in anything but psychology, to some extent, precludes the reader from fully grasping the concept, notwithstanding the two or three psych classes they may have taken.

One of my favorite SC&A quotes is: “Stupidity is a commodity, given to man in great abundance, by God.”

He shows up at the most opportune times and makes the most brilliant observations. He’s been around Cao’s blog for some of the most interesting exchanges!

So he blogs here on Some Smart People Are Idiots, here are some pearls of wisdom:

In a recent conversation with a friend- a brilliant one at that- SC&A came to a startling, and even remarkable, conclusion:

Lots of smart people are idiots.

Profound.

Now to be clear, idiots come in many varieties. There are the idiots who we review. They are classic idiots, with no sense of anything other than their self absorbed, mundane lives.The only determination to be made is just how much of an idiot they really are.

I suppose this is what I privately call: the idiot evaluation factor. It is something to do while listening to a blithering idiot, can be done while maintaining eye contact, and the secret to this evaluation is rating on a scale from 1-10. (1 being a semi-idiot, 10 being a full blown idiot) The fact that you’re processing this information while looking them straight in the face, with a look of utter and total concentration, makes it appear as though you’re taking what they’re saying seriously. Which you can laugh about later, when they’re gone.

The second type of idiot is the one who thinks he/she/it are in a position to offer a fair critique. Usually, they refer to us in a highly sexualized manner, often displaying a rather obsessed view of certain sexual tendencies. This is usually followed by name calling. Generally speaking, they are overcompensating for latent sexual feelings, but we’ll leave that between them and their mothers. You know who you are- and so do we.

It’s relatively easy to recognize when they start talking about bodily functions, sex acts, or a combination of both.

To be clear, those types of idiots are irrelevant. In fairness, for the most part, they are young, and inexperienced in nuance and subtly- which perhaps explains their obsession with cartoons. These are the same people who see profound wisdom in Cartman of South Park. As a rule, their greatest achievement was a day care graduation ceremony. They find brilliance only in themselves (maybe we should get them a new trophy).

He often points out they have a lot of trophies to show and point to how great they are. I have in fact, worked for a lot of them. One guy had a trophy room in his basement, complete with animal heads and stuffed birds he had shot and mounted. Sometimes people would give him their mounted animals, not knowing what to do with them, and he would evaluate them for their–trophy value–and if they were of high enough quality, he would clean them up and add them to his collection of trophy manliness.

At any rate we don’t read those brilliant blogs- and neither should you. Your time would be best spent actually learning something, keeping up with the news or expanding your rather pedestrian minds. Consider these pages as good starting points. Try and spend some time here, here, or here.

SC&A points to his own blog. Brilliant. What a master. And yet, some people still don’t get it. They never will. I very much enjoy him when he visits, and like to go over and see what’s cookin’ over there. Go and pull up a couch. Very entertaining.

A visit with Terri Schiavo

Terri “collapsed” under strange circumstances when she was only 26 years old.

This was written back in 2004, not long ago, around Christmastime, by Attorney Barbara Weller. You can see it here. This is a personal accounting of a visit with Terri Schiavo, not from a legal point of view, but the view of a woman; a mother, a grandmother. It could have been written in her diary.

This past Christmas Eve day, 2004, I went to visit Terri Schiavo with her parents, Bob and Mary Schindler, her sister, her niece, and Attorney David Gibbs III. The visit took place at the Woodside Hospice for about 45 minutes just before noon.

Terri has been in hospice for 5 years, since April of 2000. (Which is against the law. Schiavo’s decision to hold Terri at Hospice after it was clear that she was not “terminal” within Medicare guidelines was an improper use of the ward’s assets. In order to receive federal payment for hospice care, the facility must obtain a certification from the attending physician within two calendar days of initial admission that the patient’s “prognosis is for a life expectancy of 6 months or less if the terminal illness runs its normal course.” 42 C.F.R. § 418.22 (2001) Terri has been in Hospice 5 years, since April of 2000.)

When I knew I was going to visit Terri with her parents, I had no idea what to expect. I was prepared for the possibility that the Schindlers love their daughter and sister so much that they might imagine behaviors by Terri that aren’t actually evident to others. The media and Mr. Schiavo clearly give the impression that Terri is in a coma or comatose state and engages only in non-purposeful and reflexive movements and responses. I am a mother and a grandmother, as well as one of the Schindlers’ attorneys, and I could understand how parents might imagine behavior and purposeful activity that is not really there. I was prepared to be as objective as I could be during this visit and not to be disappointed at anything I saw or experienced.

I can see if I were in this predicament, how I would brace myself for what was to come; the media hasn’t painted a very good picture of her condition, many people consider her to be brain dead.

I was truly surprised at what I saw from the moment we entered the little room where Terri is confined. The room is a little wider than the width of two single beds and about as long as the average bedroom, with plenty of room for us to stand at the foot of her bed. Terri is on the first floor and there is a lovely view to the outside grounds of the facility. The room is entered by a short hallway, however, and there is no way for Terri to see out into the hallway or for anyone in the hallway to observe Terri.

If this woman is “on the brink of death” as the media reports, it seems strange to me that she is not somewhere where the staff can see her. I suppose keeping her “comfortable in her last hours” isn’t really a concern, considering she went there to die and has lingered for 5 more years while Michael uses the money for her rehabilitation in the fight to exterminate her.

From the moment we entered the room, my impression was that Terri was very purposeful and interactive and she seemed very curious about the presence of obvious strangers in her room. Terri was not in bed, but was in her chair, which has a lounge chair appearance and elevates her head at about a 30-degree angle. She was dressed and washed, her hair combed, and she was covered with a holiday blanket. There were no tubes of any kind attached to her body. She was completely free of any restraints that would have indicated any type of artificial life support. Not even her feeding tube was attached and functioning when we entered, as she is not fed 24 hours a day.

The thing that surprised me the most about Terri as I took my turn to greet her by the side of her chair was how beautiful she is. I would have expected to see someone with a sallow and gray complexion and a sick looking countenance. Instead, I saw a very pretty woman with a peaches and cream complexion and a lovely smile, which she even politely extended to me as I introduced myself to her. I was amazed that someone who had not been outside for so many years and who received such minimal health care could look so beautiful. She appeared to have an inner light radiating from her face. I was truly taken aback by her beauty, particularly under the adverse circumstances in which she has found herself for so many years.

She has been in hospice for 5 long years, and hasn’t had fresh air or been outside in that time. Truly remarkable.

Terri’s parents, sister, and niece went immediately to greet Terri when we entered the room and stood in turn directly beside her head, stroking her face, kissing her and talking quietly with her. When she heard their voices, and particularly her mother’s voice, Terri instantly turned her head towards them and smiled. Terri established eye contact with her family, particularly with her mother, who spent the most time with her during our visit. It was obvious that she recognized the voices in the room with the exception of one. Although her mother was talking to her at the time, she obviously had heard a new voice and exhibited a curious demeanor. Attorney Gibbs was having a conversation near the door with Terri’s sister. His voice is very deep and resonant and Terri obviously picked it up. Her eyes widened as if to say, “What’s that new sound I hear?” She scanned the room with her eyes, even turning her head in his direction, until she found Attorney Gibbs and the location of the new voice and her eyes rested momentarily in his direction. She then returned to interacting with her mother.

When her mother was close to her, Terri’s whole face lit up. She smiled. She looked directly at her mother and she made all sorts of happy sounds. When her mother talked to her, Terri was quiet and obviously listening. When she stopped, Terri started vocalizing. The vocalizations seemed to be a pattern, not merely random or reflexive at all. There is definitely a pattern of Terri having a conversation with her mother as best she can manage. Initially, she used the vocalization of “uh’uh” but without seeming to mean it as a way of saying “no”, just as a repeated speech pattern. She then began to make purposeful grunts in response to her mother’s conversation. She made the same sorts of sound with her father and sister, but not to the same extent or as delightedly as with her mother. She made no verbal response to her niece or to Attorney Gibbs and myself, but she did appear to pay attention to our words to her.

The whole experience was rather moving. Terri definitely has a personality. Her whole demeanor definitely changes when her mother speaks with her. She lights up and appears to be delighted at the interaction. She has an entirely different reaction to her father who jokes with her and has several standing jokes that he uses when he enters and exits her presence. She appears to merely “tolerate” her father, as a child does when she says “stop” but really means, “this is fun.” When her father greets her, he always does the same thing. He says, “here comes the hug” and hugs her. He then says, “you know what’s coming next—the kiss.” Her father has a scratchy mustache and both times when he went through this little joke routine with her, she laughed in a way she did not do with anyone else. When her father is ready to plant the kiss on her cheek, she immediately makes a face her family calls the “lemon face.” She puckers her lips, screws up her whole face, and turns away from him, as if making ready for the scratchy assault on her cheek that she knows is coming. She did the exact same thing both times that her father initiated this little routine joke between the two of them.

This sounds like a woman who is responsive, not someone who is “brain dead” or a “houseplant”. I can imagine this, picture, can’t you? Making a face when a guy with a scratchy face was about to rub his face on yours? I’ve seen children do this with their dads, I did it when I was young and my dad grew a beard. When my dad came back from 2 weeks camping in Canada with my brother, I saw my mother make that face in response to his nuzzling hugs.

The interactions with her family and our appearance in her room appeared to require some effort and exertion from Terri. From time to time, she would close her eyes as if to rest. This happened primarily when no one was paying particular attention to her, but we were talking among ourselves. After a few minutes or when one of the visitors approached her and started to talk directly to her again, Terri would open her eyes and begin her grunting sounds again in response to their conversations. Although I approached her, leaned close and stroked her arms and spoke to her, she did not verbally respond to me.

Terri’s hands are curled up around little soft cylinders that help her not to injure herself. I understand that these contractures are likely very painful, although there was a time when Terri was receiving simple motion therapy when her hands and arms relaxed and were no longer as constricted. When the therapy was discontinued by order of her guardian and the court, the contractures returned. These contractures would apparently be avoidable if Terri were given the simple range of motion therapy she previously received. It is very sad to observe firsthand these conditions that make her life more difficult, but that would be correctable with little effort.

It’s a travesty that this woman has been refused treatment and care that is required by law for the sake of her husband’s sick killing agenda.

When we were preparing to leave, the interactions with Terri changed. First, she went through the joke routine with her father and the “lemon face.” When her niece said goodbye to her, Terri did not react. Nor did she react to me or to Attorney Gibbs when we said our goodbyes to her. When her sister went to her to say goodbye, Terri’s verbalizations changed dramatically. Instead of the happy grunting and “uh uh” sounds she had been making throughout the visit, her verbalizations at these goodbyes changed to a very low and different sound that appeared to come from deep in her throat and was almost like a growl. She first made the sound when her sister said goodbye and then, amazingly to me, she made exactly the same sound when her mother said goodbye to her. It seemed Terri was visibly upset that they were leaving. She almost appeared to be trying to cling to them, although this impression came only from her changed facial expression and sounds, since her hands cannot move. It appeared like she did not want to be alone and knew they were leaving. It was definitely apparent in the short time I was there that her emotions changed—it was apparent when she was happy and enjoying herself, when she was amused, when she was resting from her exertion to communicate, and when she was sad at her guests leaving. It was readily apparent and surprising that her mood changed so often in a short 45-minute visit.

I was pleasantly surprised to observe Terri’s purposeful and varied behaviors with the various members of her family and with Attorney Gibbs and myself. I never imagined Terri would be so active, curious, and purposeful. She watched people intently, obviously was attempting to communicate with each one in various ways and with various facial expressions and sounds. She was definitely not in a coma, not even close. This visit certainly shed more light for me on why the Schindlers are fighting so hard to protect her, to get her medical care and rehabilitative assistance, and to spend all they have to protect her life.

I realize that Terri has good days and bad days. There are obviously days when she does not interact with her family, as they had previously told us. There are also apparently days when Terri is even more interactive and responsive to them than she was on the day I visited. Since this visit I am more convinced than ever that the Schindlers are not just parents who refuse to let go of their daughter. There really is a lot going on with their daughter and potentially, it seemed obvious to me, Terri could improve even more with appropriate care and 24 hour a day love that can only come from a dedicated family. As I watched her, my foremost thought was that on the next day, Christmas, Terri should not have been confined to her small room in a hospice center, nice as that room was, but that she should have been gathered around the Christmas dinner table enjoying the holiday with her family.

I hope that with all our efforts, that will happen for her this Christmas. There is no doubt in my mind that many laws have been broken as you can see here and here.

In the Arab world, dislike of al Qaeda grows daily

This post at Crossroads Arabia is very encouraging.

Michael Doran, of Princeton University, has a good article up in the Wall Street Journal (a for-pay site) entitled “The Iraq Effect”, which run counter to much “received wisdom” concerning the war in Iraq. In it, Doran states that while intense dislike of the US combat in Iraq continues unabated, in much of the Arab and Muslim world, the dislike of Al-Qaeda and its supporters grows daily. In their efforts to see only evil in the Arab world, many American critics (as well as European critics) are failing to note the deliberate changes which they should be applauding.

To me, with the idea of al-takeyya and hudna, I am very hesitant to believe there are changes that will make differences in the long run. Right now we have problems on our own soil with honor killings and murders of Christians. To think or imagine these things will stop is going to take a lot of convincing.

The war that is going on through the Islamic world is one for the heart of Islam. It is decidedly to our benefit, as Americans, to realize just what is happening and to give appropriate support–mostly moral and verbal–to those reformers who are trying to create in their countries the conditions necessary to co-exist with a modernizing world.

Most assuredly, I am in favor of change in Iraq; in the Middle East in general–I’d like to see women voting in Saudi Arabia, for example. I hesitate to mention what exactly I think those things should be, but will consider and watch as time goes on. As someone said in Iraq, they might not see the freedom they dream of in this lifetime, but at least they can see it happening for their children. It will be interesting to see if the Shiites’ represented in Iraq will be Shiites supported by the mullahs in Iran.

Michael can ONLY remove the feeding tube if that act does not interfere with providing Terri water and food. What he did last time, withholding water and food, was absolutely illegal!!!!

The Americans with Disabilities Act (ADA), 42 U.S.C. Sections 12101 provides that necessary and appropriate rehabilitation services and physical motor skill therapy may not be denied a substantially disabled patient in the United States of America.

Cf 28 CFR, Ch 1, Subpart B, Sect 35.130 States

“Nothing in the Act or this part authorizes the representative or guardian of an individual with a disability to decline FOOD, WATER, medical treatment, or medical services for that individual.”

When I was frequenting shows with Nick Cywink, he talked about indian wannabes. Nick is Ojibway from Whitefish Falls, Ontario, Canada. There was one guy who used to come around and talk about his native heritage. But it Turned out the guy was a total fake and they called him “the coyote”. Looks to me like Ward Churchill is another “coyote”.

And there’s more over at Michelle Malkin’s place.

“It is an original art work by me, after Thomas Mails,” Churchill said. “The fact that the purchaser was ignorant of the reality of what was perfectly publicly stated at the time the edition was printed is not my responsibility.”

However, no credit was given to Mails on the artwork, and Churchill refused to provide documentation to back his claims.

Intellectual property attorney Jim Hubbell told the Denver station such documentation, if it exists, still would not protect Churchill from copyright infringement unless he had consent from Mails.

The son of the late Thomas Mails told KCNC the family retains the copyright.

“My father invested a great deal of himself in his work, and from that he developed a great fierceness in defending his work,” Ryan Mails said. “I cannot imagine he would ever grant permission to anyone to copy one of his pieces.”

The interesting part of the Worldnet Daily article is the part where they talk about his being under investigation, and I’m sure a lot of us will be interesting in hearing the outcome:

Churchill resigned his position as head of the Colorado University ethnic studies program but kept his $96,000 per year teaching post. He steadfastly has refused to apologize for his comments.

He’s also come under fire for claiming an American Indian heritage, training terrorists, and meeting with Libya’s Moammar Gadhafi in the 1980s when the U.S. had banned travel there.

In addition, he’s accused of writing essays with passages “almost identical” to those of other authors.

The University of Colorado Regents is probing whether Churchill has violated tenure and expects to announce a decision in March.

I can’t wait to hear what that “decision” may be, can you?

Are Greer Bush & Schiavo above the law?

The laws are already there to protect Terri. We don’t live in a society where Euthanasia is legal. So I have to ask the question: Why hasn’t something been done on at least one of these counts? From Sweet Liberty with a few of my own comments thrown in:

Fla. Stat. § 415. 102(1)(2002). Michael Schiavo’s isolation of Terri and refusal to provide adequate physician attention, rehabilitative services, dental care and other medical services constitutes abuse under the Adult Protective Services Act as well as the guardianship statutes.

Terri is on a single gastric feeding tube. She is on the feeding tube because Michael ordered it. She used to eat soft foods from a spoon until Michael put a stop to it. Terri is under guard right now to prevent anyone from giving her food orally or stimulating her in any way. I have never heard of this before, but it appears as though actions are being taken to keep her in an illegal state of disability. Michael Schiavo refuses to allow a swallow test. Dr. William Hammesfahr determined back in 2000 that Terri can swallow. In the spring of 2000, three physicians, including Dr. Jay Carpenter, who is a former Chief of Medicine at Morton Plant Hospital, filed affidavits after observing Ms. Schiavo. All three physicians stated that it is visually apparent that Ms Schiavo is able to swallow and, in fact, does swallow her own saliva. ENT: The patient can clearly swallow, and is able to swallow approximately 2 liters of water per day (the daily amount of saliva generated). Water is one of the most difficult things for people to swallow. It is unlikely that she currently needs the feeding tube. She should be evaluated by an Ear Nose and Throat specialist, and have a new swallowing exam.

Michael Schiavo defrauded the courts by promising to care for Terri for the rest of his life and then used the jury awarded $700 thousand specifically designated for Terri’s rehabilitation for his own personal gain and to end Terri’s life. This also violates Fl Statute. 825.103 “Exploitation of an elderly person or disabled adult” which prohibits the misuse of a disabled person’s funds by the guardian.

Further, Section (2)(a) states that If the funds, assets, or property involved in the exploitation of the elderly person or disabled adult is valued at $100,000 or more, the offender commits a felony of the first degree, punishable as provided in s. 775.082, s. 775.083, s. 775.084.

The Americans with Disabilities Act (ADA), 42 U.S.C. Sections 12101 provides that necessary and appropriate rehabilitation services and physical/motor skill therapy may not be denied a substantially disabled patient in the United States of America.

Cf 28 CFR, Ch 1, Subpart B, Sect 35.130 States “Nothing in the Act or this part authorizes the representative or guardian of an individual with a disability to decline food, water, medical treatment, or medical services for that individual.”

Failure to Discharge His Duties under FS § 744.474 (2) requires that the guardian protect the rights of the ward, provide for her health and safety, properly manage her financial resources and help her regain her abilities to the maximum extent possible.

The initial move to Hospice was done in violation of the annual plan and without court permission in violation of FS § 744.3215(4)].

Terri has the right to receive visitors and communicate with others. FS § 744.3215

Terri has the right to receive “palliative care” which is the comprehensive management of the physical, psychological, social, spiritual, and existential needs of the patient. FS. § 765.102.

In 1990, Michael took Terri to San Francisco for experimental medical treatment, without the necessary prior approval of the Court. FS. § 744.3215(4).

The guardian is required by law to prepare and present an annual plan. FS § 744.3675.Repeatedly, the annual plans have been filed late or not at all

In his annual reports, Schiavo has failed to prepare and present any plan for the provision of medical, mental health, and rehabilitative services in the coming year as required by FS §744.3675 (1)(b)(3)

The Adult Protective Services Act (Chapter 415 of the Florida Statutes) affords protection to disabled persons from abuse, neglect and exploitation

Fla. Stat. § 415. 102(1)(2002). Schiavo’s isolation of Terri and refusal to provide adequate physician attention, rehabilitative services, dental care and other medical services constitutes abuse under the Adult Protective Services Act as well as the guardianship statutes.

Schiavo’s decision to hold Terri at Hospice after it was clear that she was not “terminal” within Medicare guidelines was an improper use of the ward’s assets. In order to receive federal payment for hospice care, the facility must obtain a certification from the attending physician within two calendar days of initial admission that the patient’s “prognosis is for a life expectancy of 6 months or less if the terminal illness runs its normal course.” 42 C.F.R. § 418.22 (2001) Terri has been in Hospice 5 years, since April of 2000.

The Florida courts, DCF and Adult Protective Services have failed to do their job of protecting Terri’s rights under the existing Florida statutes. When people say that “case law” is on the side of Michael Schiavo, considering my limited knowledge of the law, I just have to wonder–what kind of “cases” ignored all the laws that protect the handicapped? Governor Jeb Bush has always had the executive power to remove Michael Schiavo as Terri’s legal guardian and to require a full investigation through every possible legal avenue, yet he hasn’t done it.

So what the hell is going on here?

Fadhli attended Islamic Saudi Academy High School.

It is also important to note the connection here: The Islamic countries in the Middle East and their support of terrorism in Iraq.

Saudi Elections Feb 10 but women aren’t allowed to vote

Foreign Minister of the Kingdom of Saudi Arabia, Prince Suud Al-Faisal has said women will be given the right to vote in the next elections.

Currently in Great Britain for an official visit, the Minister said the Election commission had proposed that women could vote and that he would not be surprised if this is put into effect “by the next elections”.

In the partial local elections held on February 10 in Saudi Arabia, only men voted and the second and third rounds of the polls will be held in March and April. However, it is not known whether the Prince referred to these rounds or an election in the future when he said, “next elections”.

Even though Saudi laws do not legislate against women voting, and every citizen over 21 has the right to vote, legislation is necessary to encourage public opinion to accept the idea of women casting votes.

READING THE GOSPEL IS NOT HATE CRIME

Much to my relief, and I’m sure many out there who are reading, the ridiculous charges against the Christians in Philadelphia were finally dropped against the Philadelphia Four, which is GOOD NEWS!

Thanks, in part, to a loud public outcry that included a ConservativePetitions.com effort, all charges were dismissed against the “Philadelphia Four” on Feb. 17. The Christians were threatened with 47 years in prison for the “hate crime” of preaching the Gospel during a homosexual street fair last October. Thank you for your support of this petition.
